Welcome to DTenant! These Terms and Conditions ("Terms") govern your use of our smart property management platform at dtenant.com ("Platform"). By creating an account or using our services, you agree to these Terms.

1. About DTenant

DTenant is a digital property management platform that helps landlords and property managers in Kenya streamline rental operations, manage tenants, process payments, and maintain property records. We serve both property owners and tenants through our comprehensive platform.

2. Who Can Use DTenant

Eligibility Requirements

  • • You must be at least 18 years old
  • • You must have legal capacity to enter into contracts
  • • Property owners must have legal rights to the properties they manage on our platform
  • • You must provide accurate and complete information during registration

Account Types

  • Property Owners/Landlords: Manage properties, tenants, and rental operations
  • Property Managers: Manage properties on behalf of owners with appropriate permissions
  • Tenants: Access tenant portal features, make payments, and communicate with landlords

3. Your Account and Responsibilities

Account Security

  • • You are responsible for maintaining the confidentiality of your login credentials
  • • You must notify us immediately of any unauthorized access to your account
  • • You are liable for all activities that occur under your account

Accurate Information

  • • You must provide truthful, accurate, and complete information
  • • You must keep your account information updated
  • • Property owners must verify they have legal rights to manage listed properties

Prohibited Uses

You may not use DTenant to:

  • • Violate any laws or regulations
  • • Infringe on others' intellectual property rights
  • • Upload malicious software or harmful content
  • • Harass, abuse, or harm other users
  • • Use the platform for fraudulent activities
  • • Attempt to reverse engineer or hack our systems

For Tenants

Service Availability

  • • We strive for 99.9% uptime but cannot guarantee uninterrupted service
  • • We may perform scheduled maintenance with advance notice
  • • We reserve the right to modify or discontinue features with reasonable notice

5. Payments and Pricing

Subscription Model

  • • Pricing is per occupied unit as displayed on our website
  • • Vacant units are managed free of charge
  • • Payment is due monthly in advance
  • • We accept payments through our integrated payment partners

Payment Processing

  • • We use third-party payment processors (including Stripe)
  • • Payment processing fees may apply as communicated
  • • We do not store your complete payment card information
  • • Refunds are subject to our refund policy

Late Payments

  • • Accounts may be suspended for non-payment after 7 days past due
  • • A grace period of 3 days applies for technical payment issues
  • • Service will be restored immediately upon payment

6. Data and Privacy

Your privacy is important to us. Our comprehensive Privacy Policy explains how we collect, use, and protect your information.

  • • You can remove your content at any time by deleting it from your account

8. User Content and Conduct

Content Standards

  • • All content must be lawful, truthful, and appropriate
  • • No discriminatory, offensive, or harmful content is allowed
  • • Property listings must be accurate and legally compliant
  • • Communications must be respectful and professional

Content Monitoring

  • • We reserve the right to review and remove inappropriate content
  • • We may suspend accounts for violations of our content standards
  • • Repeated violations may result in permanent account termination

9. Third-Party Services

We integrate with various third-party services including:

  • • Payment processors (Stripe, mobile money services)
  • • Communication services (SMS, email providers)
  • • Cloud storage and hosting services

  • • Third-party services have their own terms and conditions
  • • We are not responsible for third-party service failures or policies

10. Limitation of Liability

  • • We are not liable for indirect, incidental, or consequential damages
  • • Our total liability is limited to fees paid in the 12 months prior to the claim
  • • We do not guarantee specific outcomes from using our platform

User Responsibility

  • • Property owners are responsible for legal compliance with tenancy laws
  • • Users must backup important data independently
  • • We recommend consulting legal professionals for complex property matters

11. Termination

Your Right to Terminate

  • • You may cancel your account at any time
  • • No cancellation fees apply
  • • You can export your data before cancellation

Our Right to Terminate

  • • We may suspend or terminate accounts for Terms violations
  • • We may discontinue the service with 30 days' notice
  • • Immediate termination applies for serious violations or illegal activities

Effect of Termination

  • • Access to the platform will be discontinued
  • • Data will be retained according to our Privacy Policy
  • • Outstanding payments remain due

12. Dispute Resolution

  • • We encourage resolving disputes through direct communication

  • • Most issues can be resolved quickly through dialogue

Governing Law

  • • These Terms are governed by the laws of Kenya

14. General Provisions

Entire Agreement

  • • Previous agreements or communications are superseded by these Terms

Severability

  • • If any provision is found invalid, the remainder of these Terms remain in effect
  • • Invalid provisions will be replaced with similar valid terms when possible

No Waiver

  • • Our failure to enforce any provision does not waive our right to do so later
  • • Waivers must be in writing to be effective

Assignment

  • • You may not transfer your account or obligations without our consent
  • • We may assign these Terms in connection with business transfers
